Kenyan doctors taking advantage of their patients for depraved s3xual gratification

The doctor pricked your son and you want to sue, right? Or is that yesterday’s pain-relief jab brought down the curtains on your mojo and you just can’t bring yourself to accept that it’s old age? The calls a scribe receives from aggrieved public could be, well, sad. Last week, for instance, there was a call from a lady seeking help – from a journalist – to have a medic apprehended by police for treating her toddler ‘to silence.’ Says the woman: “Tangu mtoto atibiwe last week, hajalia.”  Working in a newsroom comes with its perks...or should I say packs.

Every caller has a package for you. A package with a case that needs to be solved... and it better pay when it is published. Mostly, they are cases of suspected medical negligence. Fine, I understand why journalists would be the first line of ‘attack.’

It however beats logic how they would be helpful to get you the compensation you so desperately need. What many Kenyans don’t know (or are deliberately ignorant of) is that there is due process to register medical complaints with relevant authorities. The Kenya Medical Practitioners and Dentists Board (MPDB) primarily deals with such complaints. “Any person – treated on Kenyan soil – who believes that they have been wronged by a medical practitioner or a hospital facility, can lodge a complaint with us,” says Daniel Yumbya, the CEO of the board. “The board will engage the complainant and the defendant until the truth is established through a sitting tribunal,” he explains. Through its deliberations, using evidence at its disposal, the board will determine whether those accused are culpable and to what extent.

Unfortunately, it cannot order, like a court would, for compensation. Instead, “we will offer possible avenues for settling cases,” says Yumbya. Consequently, if the board finds the practitioner guilty, they could order retraining or deregistration of a member (all practitioners in Kenya are registered with the board). A case concluded by MPDB can be taken to court, which could then order for specific compensation. Like Dr Florentius Koech of Moi Teaching and Referral Hospital says, “being a medical doctor is first a calling before it is a career.” But that there are quacks in the market is not in doubt. It’s why there have been cases of perverts who take advantage of their patients, especially female ones for some depraved sexual gratification. A friend once confided in me that her gynae seemed to love touching her private areas because “he was palpating for a pulse.” Don’t get me wrong. Of course your doctor may need to touch you during an examination.

There is however a limit. This limit, I believe, is up to you to decide. There are signs to look out for to ascertain whether the touching is necessary. Is the doctor making faces or odd sounds when touching you? If so, that should be a red flag. What you need to do thereafter is gather enough evidence and lodge a complaint with MPDB. You may run to the newsroom, yes, but journalists cannot do more than pen or air the story and hopefully the publicity will spur relevant authorities into action. Most importantly however, the due process of law must be followed and it is advisable that you first lodge a complaint before talking to the press. It must also be kept in mind that before a journalist establishes the ‘truth’ according to a patient’s complaints, it will take a while before the ‘compensation’ is settled, if at all.
